1. Agreement to Terms
By accessing or using Checksheets.com ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Checksheets.com provides a platform for creating, managing, and exporting construction and engineering inspection checksheets and test records. Our services include:
- Access to a library of pre-built industry-standard checksheets
- Tools to create and customise checksheets
- PDF export functionality with customisable templates
- Team collaboration features (on applicable plans)
- Cloud storage for your checksheet data
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party and to notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
3.3 Account Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
4. Subscriptions and Payments
4.1 Subscription Plans
Some features of the Service are available on a subscription basis. You will be billed in advance on a recurring monthly or annual basis depending on the subscription plan you select.
4.2 Free Trial
We may offer a free trial period for new users. At the end of the free trial, you will be required to subscribe to continue using premium features. You may cancel at any time during the trial period.
4.3 Payment Processing
All payments are processed securely through Stripe. By providing payment information, you authorise us to charge your payment method for all fees incurred. We do not store your full payment card details.
4.4 Refunds
Subscription fees are non-refundable except where required by law. If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others, including intellectual property rights
- Transmit any malicious code, viruses, or harmful content
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use the Service for any fraudulent or deceptive purposes
- Collect or harvest user data without consent
- Use automated systems or software to extract data from the Service (scraping)
- Resell or redistribute the Service without our express written consent
6. Intellectual Property
6.1 Our Content
The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Checksheets.com. The Service is protected by copyright, trademark, and other intellectual property laws.
6.2 Your Content
You retain all rights to the checksheets and content you create using our Service. By using the Service, you grant us a limited licence to store, display, and process your content solely for the purpose of providing the Service to you.
6.3 Template Library
Our library of checksheet templates is provided for your use within the Service. While you may export and use these checksheets in your projects, you may not redistribute, sell, or claim ownership of our template library.
7. User-Generated Content
You are solely responsible for the content you create, upload, or share through the Service. You represent and warrant that:
- You own or have the necessary rights to use and authorise use of all content you submit
- Your content does not violate the privacy rights, publicity rights, copyright, or other rights of any person
- Your content is accurate and not misleading
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Service will be uninterrupted, timely, secure, or error-free
- Warranties regarding the accuracy or reliability of any information obtained through the Service
Important: The checksheets provided through our Service are templates and guides only. They do not constitute professional engineering advice. Users are responsible for ensuring that any checksheets used comply with applicable codes, standards, and regulations for their specific project and jurisdiction.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Checksheets.com and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your use or inability to use the Service
- Damages resulting from any unauthorised access to or use of our servers
- Damages resulting from any interruption or cessation of transmission to or from the Service
Our total liability to you for all claims arising from the use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Checksheets.com and its directors, employees, partners, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
14. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
